In recent weeks a veritable tsunami of fundraising appeals have flooded Inboxes as partisan NGOs look to capitalize on the COVID-19 elections crisis, focusing on Vote by Mail (VBM) as either the solution to protect democracy, or an evil nexus of corruption. Some on the left insist that Democrats must promote universal VBM if they are to defeat Trump. Others on the right proclaim that the Democrats must be stopped from stealing the elections through VBM fraud, despite virtually no proof that such fraud existed in past elections.

Common ground and reasonable solutions do in fact exist, but time is quickly running out for a strong bipartisan push to ensure that effective, state-based efforts are funded and ready for 2020, and that our ballots are secured from hacking and counted with accuracy and transparency.

NEDC Requests THAT THE EAC Investigate ES&S VOTING SYSTEMS

In a letter obtained by NBC News sent to the EAC on Tuesday, the National Election Defense Coalition asked the agency to look into whether ES&S violated agency regulations by implying that DS200 voting machines with modems are EAC certified.

“ES&S has repeatedly advertised its DS200 with internal modem — a critical component to ES&S’s voting systems — as being EAC certified when, in fact, it is not,” the letter said. “We therefore again respectfully request that EAC investigate and take action to correct this serious issue.”


NEDC in PA Court Fighting AGAINST ES&S ExpressVote XL

PHILADELPHIA, PA (Dec, 2019) – A coalition of advocacy groups and voters has filed a lawsuit against Pennsylvania Secretary of the Commonwealth Kathy Boockvar alleging that the state’s use of the ExpressVote XL voting machines violates the Election Code and the Pennsylvania Constitution.

The plaintiffs in the lawsuit include the National Election Defense Coalition (NEDC), the Pennsylvania-based Citizens for Better Elections (CBE), and individual Pennsylvania voters. The BakerHostetler law firm serves as counsel for the plaintiffs.

There’s a lot to like in Congress’s new election security measures. But there’s a big omission.

There’s a lot to like in this year’s appropriations agreements, starting with a lump sum for states to bolster critical voting infrastructure. The $425 million Congress is providing in 2020 comes many days late and many dollars short according to experts, who say billions were needed starting at least two years ago. But it’s still an improvement over the $380 million allocated in 2018, and the $0 allocated this past year. These funds will be doled out in grants to states, which can then decide how to use them.

September, 2019:
Senate appropriators allocated $0 for election security at the Sept 17th FSGG Appropriations Committee hearing.

However, immediately following a press conference by NEDC and conservative advocates on September 18th, including Grover Norquist of Americans for Tax Reform and Adam Brandon of FreedomWorks, Senator McConnell reversed course, co-sponsoring an amendment allocating $250 million for election security.

NEDC SUPPORT FOR BIPARTISAN LEGISLATION

On August 22, 2018, Senator James Lankford delivered a speech on the floor of the U.S. Senate about his bipartisan Secure Elections Act.

NEDC Congressional education helped galvanize the Secure Elections Act (S.2593), introduced in December of 2017 by a bipartisan group of six Senators; James Lankford (R-OK), Amy Klobuchar (D-MN), Lindsey Graham (R-SC), Kamala Harris (D-CA), Susan Collins (R-ME), and Martin Heinrich (D-NM).  The PAPER Act (H.R. 3751) also has strong bipartisan support, including Grover Norquist and Americans for Tax Reform. The immediate aim of both bills is to secure federal support for states and counties to replace antiquated paperless voting machines before the 2018 and 2020 federal elections and to press for policy changes to ensure election administrators have the auditing tools and training to detect and thwart a cyber-attack.
